General
- The
term 'Cyberfire' refers to Cyberfire Website Design. The
term 'Client' refers to the person(s) who employs the
services of Cyberfire Website Design. These Terms and
Conditions are subject to change without notice.
- These
Terms and Conditions apply once Cyberfire has agreed to
be employed by the client for the term of the project.
- Before
work commences a deposit of 30% is required. Once the
site is complete, payment in full must be made within
14 days of the site going 'live'.
- The
client is responsible for obtaining copyright permissions
for all reproduced material on the site i.e.: photos,
artwork, text etc.,. Any copyright infringements and
legal issues will be the sole responsibility of the client.
Cyberfire has no legal responsibility to the content or
copyright status of the website except for original Cyberfire
artwork.
- The
client is responsible for the accuracy of their website
content. Spellings and minor errors will be corrected
free of charge by Cyberfire.
- Cyberfire
will carry out, on your behalf, domain name registration
and hosting arrangements on the understanding that the
client assumes responsibility when the fees are due for
renewal.
- Cyberfire
cannot be held responsible for domain registration and
hosting companies who cease trading.
- All
domain name registrations will be made in the clients
name and therefore the client will 'own' their domain
name.
- The
client is responsible for the domain name they choose
to register, spelling and wording must be clarified before
purchase. Cyberfire is not accountable for faults after
purchase. The client will assume all responsibility should
any copyright or trademark infringements occur.
- Clients
who knowingly register competitors domain names are responsible
for any legal action taken up by the 'competitor'.
- For
Custom Website Design clients: The price for additional
pages is based on the additional pages being of the same
style and design as the first one. If the additional pages
are completely new designs, they will be priced individually.
- We
wish our clients and their websites every success for
the future. We hope once you have used Cyberfire, you
will recommend us to friends and colleagues (although
this is purely a request and not a condition!).
Site
Maintenance Contracts for L1, L2 & L3.
- Level
1 (L1) Site
Maintenance is free for 6 months after the website is
uploaded. The client then assumes responsibility for the
maintenance of the site unless a Site Maintenance contract
is purchased.
- The
L1 contract is offered in good faith and therefore alterations
cannot be guaranteed the same day (although we will do
our best).
- Site
Maintenance contracts are subject to change without notice.
Contracts will be honoured for their full duration under
the terms they were purchased.
- Although
Site Maintenance contracts limit the number of image additions
per month, there is no accumulative effect for missed
months. Images in excess of the contract limit may be
subject to an hourly charge.
- Images
MUST be no more than 72dpi (especially if emailed!). If
you have any doubts please contact us.
- Images
that require more than basic preparation work may be subject
to an hourly charge.
- Text
amendments for (L2)
are limited to a few words as opposed to whole paragraphs.
Text supplied by the client on disk or by email however
is not limited to a word count.
- Text
amendments for (L3)
are limited to a few sentences as opposed to whole pages.
Text supplied by the client on disk or by email however
is not limited to a word count.
- I
dunno, all these terms for a simple contract, but we need
to clarify and protect your obligations and interests
as well as those of Cyberfire.
